Privacy Policy

WayFi Wireless LLC ("WayFi," "we," "us," "our") provides a Wi-Fi platform and partner dashboard. This policy explains what personal information we collect from account holders and partners, how we use it, how we share it, and the choices available to you.

Scope. This policy applies to the WayFi partner dashboard at app.mywayfi.com and to WayFi's business relationships with its partner organizations. It does not apply to any third-party website, product, or service, including those linked from our dashboard, each of which is governed by its own privacy policy.

This policy is a notice, not a contract. It describes our current practices. It does not create any contract, and it does not create rights or remedies beyond those provided by applicable law. Where this policy describes a practice more protective than the law requires, that description is a statement of present practice and not a binding commitment.

Information we collect

We collect only what we need to operate the service:

  • Account information — your name, email address, account credentials, and the organization and role you are associated with.
  • Business information — details you provide about your organization and the locations you operate, including business addresses.
  • Financial and payout information — records of payments we make to you, and limited status information about your payout account. See Payments and financial information.
  • Usage information — how you interact with the dashboard, including log and device information such as IP address, browser type, and timestamps.
  • Communications — messages you send us for support or other purposes.

We collect this information directly from you, automatically as you use the service, and from service providers who help us operate it.

Sensitive personal information

Some privacy laws treat certain information as "sensitive." The only such category we collect is your account log-in credentials — the email address and password used to access your account.

We use them for one purpose: authenticating you and securing your account. We do not use or disclose them for any other purpose, we do not use them to infer characteristics about you, and we do not sell or share them. Because our use is limited to purposes that applicable law permits without a right to limit, no limitation request is necessary.

Financial account numbers and government identifiers are not collected by us. They go to Stripe.

Payments and financial information

Payments to partners are processed by Stripe. WayFi is not a bank or a financial institution.

You provide your banking and tax information directly to Stripe, not to us. Bank account numbers, routing numbers, taxpayer identification numbers, identity verification documents, and tax forms are collected and held by Stripe under its own privacy policy and its own regulatory obligations, including identity verification and tax reporting. We do not receive, store, or have access to them. Stripe's privacy policy is available at https://stripe.com/privacy. Your relationship with Stripe is governed by Stripe's own terms, and we are not responsible for Stripe's handling of the information you give it.

What we keep is limited to what we need to pay you and to keep our records straight: the status of your payout account, whether payouts are enabled, and the last four digits of the account to be paid so you can confirm it is the right one. We also keep records of the payments we have made — amounts, dates, and the periods they cover.

We do not store full bank account numbers, routing numbers, taxpayer identification numbers, payment card numbers, or identity documents.

How we use information

We use personal information to:

  • provide, maintain, and improve the service;
  • create and manage your account and control what you can access;
  • calculate and make payments to you;
  • respond to your questions and provide support;
  • send you service-related messages such as verification, invitations, password resets, and notices about changes;
  • protect the service, detect and prevent fraud and abuse, and maintain security; and
  • comply with our legal, tax, and recordkeeping obligations.

We do not sell your personal information, and we do not use it to build advertising profiles or to serve you targeted advertising.

How we share information

We share personal information as follows:

  • Service providers. We use third parties to host our infrastructure, process payments, send email, provide customer support, and provide mapping services. Their access is limited to performing those services for us, subject to the terms of our agreements with them and their own applicable terms.
  • Legal and safety. We may disclose information when we believe in good faith that it is required by law or legal process, or is reasonably necessary to enforce our agreements, or to protect the rights, property, or safety of WayFi, our users, or others.
  • Business transfers. If we are involved in a merger, acquisition, financing, reorganization, or sale of assets, personal information may be transferred as part of that transaction, and we will provide notice as required by applicable law.

We do not sell your personal information, and we do not share it for cross-context behavioral advertising.

Network data

WayFi supports carrier Wi-Fi offload. Individuals connect to partner Wi-Fi networks automatically through their mobile carrier.

WayFi does not operate a captive portal, sign-up form, or registration page for people who connect, and we do not ask them for personal details. Network authentication and accounting are performed using carrier-issued identifiers, and those identifiers are not retained in WayFi's analytics systems — the venue and network figures shown in the dashboard are aggregate counts and totals that do not identify individuals.

Individuals who connect have a relationship with their mobile carrier, and their carrier's privacy policy governs the subscriber information that carrier holds.

How long we keep information

We retain each category for the period below, or for the period required to meet the purpose it was collected for, whichever is shorter — except where a longer period is required by law:

Where we are required to keep information — including for tax, financial reporting, legal hold, or dispute resolution — we retain it for as long as that requirement lasts.

Security

We maintain administrative, technical, and physical safeguards designed to protect personal information appropriate to its nature, including encryption of data in transit, role-based access restrictions intended to limit access to an organization's own data, and one-way hashing of account passwords. Information you provide to Stripe is held by Stripe and is not stored in our systems.

No method of transmission or storage is completely secure, and we cannot and do not guarantee the security of your information. You are responsible for keeping your account credentials confidential and for activity that occurs under your account. Notify us promptly at info@wayfiwireless.com if you believe your account has been compromised.

If a security incident affecting your personal information occurs, we will provide notice as required by applicable law.

Your privacy rights

Depending on where you live, you may have the right to:

  • know and access the personal information we hold about you;
  • correct information that is inaccurate;
  • delete personal information we collected from you;
  • receive a copy of your information in a portable format;
  • opt out of the sale or sharing of personal information and of targeted advertising — we do none of these, so there is nothing to opt out of; and
  • not be discriminated against for exercising these rights. We will not deny you service, charge a different price, or provide a lower quality of service because you exercised a privacy right.

Residents of states with comprehensive privacy laws — including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and Montana — have these rights by statute. As a matter of practice, we make the same process available to everyone.

Limits on these rights

Some information cannot be deleted or disclosed on request. This includes records we must retain for tax and financial reporting, information subject to a legal hold or an actual or anticipated dispute, information whose disclosure would compromise the privacy or rights of another person, and information we must retain to comply with law. Information held by Stripe is subject to Stripe's own obligations, and a request to us cannot reach it — contact Stripe directly.

Where we cannot fulfill a request in whole or in part, we will tell you why.

How to exercise your rights

Email info@wayfiwireless.com and describe the request you are making. We will respond within the timeframe required by applicable law. We will take reasonable steps to verify your identity before acting on a request, and we may decline a request we cannot verify. You may use an authorized agent with proof of authorization. If applicable law gives you a right to appeal our decision, you may appeal by replying to our response.

Children

The service is a business tool intended for use by adults acting on behalf of an organization. It is not directed to children, and we do not knowingly collect personal information from anyone under 18. If you believe a child has provided us personal information, contact us and we will delete it.

Third-party links and services

The dashboard may link to third-party websites and services, including Stripe. We do not control them and are not responsible for their content, security, or privacy practices. Review their policies before providing information to them.

United States

The service is offered from and intended for use in the United States, and information we collect is processed in the United States. We do not offer the service to individuals in the European Economic Area or the United Kingdom, and this policy makes no representations under the GDPR or UK GDPR.

Changes to this policy

We may update this policy from time to time. The current version is always posted at this address with its effective date. Where a change is material, we will provide notice as required by applicable law and, where practicable, by email to account holders. Your continued use of the service after an update takes effect indicates your awareness of the updated policy.

General

  • Governing law. This policy is governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws rules, except where applicable privacy law requires otherwise.
  • No third-party rights. This policy does not create rights in any person who is not a WayFi account holder or partner.
  • Severability. If any provision of this policy is held unenforceable, the remainder stays in effect.
  • Interpretation. Headings are for convenience only. Where this policy conflicts with a written agreement between WayFi and your organization, that agreement controls.
